Chapter 70 ILCS 1505/7.02, enables the Board of Commissioners to “establish by ordinance all needful rules and regulations for the government and protection of parks.”

Therefore, it is recommended that the Board of Commissioners consider the proposed amendments to Chapter V of the �첥��Ƶ Code to 1) use consistent language across personnel policies; 2) remove ambiguous language; 3) align Military Leave with federal and state laws and ensure Peace Corps leave comply with the rules outlined in the Illinois Administrative Code; 4) align the taking of Vacation and Personal leave with the Chicago Paid Leave Ordinance and all applicable laws by reducing the previous six-month probationary period to 90-days for all non-union employees (union staff remain subject to the terms of their applicable collective bargaining agreement or “CBA”), and 5) expand the District’s Victims’ Economic Security and Safety Act (“VESSA”) policy to align with state law.

Regarding the Proposed Amendments to Chapter V Sections B.1 and B.7 of the �첥��Ƶ Code, the General Superintendent finds that extraordinary circumstances exist such that waiver of the 45-day notice period pursuant to Chapter 1, Sections B.2., B.7, and B.10 of the Code is necessary to allow the Park District to implement the aforementioned personnel policy changes.

It is recommended that the Board of Commissioners consider the proposed amendments to Chapter II of the �첥��Ƶ Code in order to (1) establish that the Department of Audit operates within the Office of the Inspector General (OIG) and that auditing is one of the OIG’s functions, and (2) in conjunction with the advent of publishing the OIG’s audit reports on the OIG’s website, clarify that the OIG’s investigative files will remain confidential.

Chapter 70 ILCS 1505/7.02, enables the Board of Commissioners to “establish by ordinance all needful rules and regulations for the government and protection of parks” Therefore, it is recommended that the following chapter of the �첥��Ƶ Code be amended to reflect the following additions or modifications of language and/or section:

It is recommended that the Board of Commissioners consider the proposed amendments to Chapter V of the �첥��Ƶ Code to achieve consistent language across personnel policies; ensure consistency with leave provided by statute including the Family Medical Leave Act (FMLA) and Victims’ Economic Security and Safety Act (VESSA); and to expand the Park District’s Paid Parental Leave Policy to provide up to 12 weeks of paid leave for eligible employees beginning January 1, 2025.

ABOUT THE PROPOSED AMENDMENTS:

Chapter 70 ILCS 1505/7.02 enables the Board of Commissioners to “establish by ordinance all needful rules and regulations for the government and protection of parks.” Therefore, it is recommended that the Board of Commissioners consider the proposed amendments to Chapter II to update the report process for the �첥��Ƶ’s Office of the Inspector General and to include recent amendments to the Open Meetings Act regarding remote attendance. The proposed amendment to the Chapter II of the Code can be found below.

Pursuant to Chapter 1, Section B.2 of the �첥��Ƶ Code, the Secretary shall then initiate a notice period of at least 45-days to provide public notice and to solicit public input regarding the proposed amendments. Once the 45-day notice period has concluded, the General Superintendent or their designee may recommend that the Board approve the requested amendments.

Upon final approval of the amendments, the General Counsel shall review, prepare and publish electronic copies of the Code of the �첥��Ƶ that have been revised by reason of these amendments.

It is recommended that the Board of Commissioners consider the proposed amendments to Chapter XI of the �첥��Ƶ Code to update the rules and procedures governing the �첥��Ƶ’s procurement of and contracts for goods, services, and construction. The proposed amendments include, but are not limited to the following changes:

• Section C regarding “Power to Contract” was updated to clarify and update the authority to enter into contracts:
  • The Director of Purchasing has the authority to enter into contracts where the dollar amount does not exceed $20,000 (Section C.1);
  • The General Superintendent has the authority to enter into contracts where the dollar amount does not exceed $200,000 (Section C.2.a); and
  • The Board of Commissioners must authorize any contract where the dollar amount exceeds $200,000 (Section C.3.a). Further, for any contract approved by the Board, the Board must separately approve the exercise of an extension option provided for in the original contract.
• Section C also sets the authority to authorize change orders as follows:
  • The Director of Purchasing has the authority to approve change orders not to exceed $20,000 (C.1);
  • The General Superintendent has the authority to approve change orders not to exceed $100,000 (C.2.b); and
  • The Board of Commissioners has the authority to approve change orders exceeding $100,000 (C.3.b).
• The Board of Commissioners may also authorize pre-qualified contractor pools, which are subject to caps set by the Board of Commissioners, where the Board must separately approve any project awarded to or work bought from the pool in excess of the caps (Section C.3.c).
• The reports to the Board of Commissioners required under Section C were also expanded to provide specificity regarding the nature and content of the reports including the addition of a report where a single change order or the aggregate change orders for a contract exceed 20% of the original contract value (Section C.4).
• The threshold for competitive bids under Section D was also updated as follows:
  • Purchases or contracts valued between $15,000 and $20,000 follow a more abbreviated competitive bid process as set forth in Section D.1.a.
  • Contract values exceeding $20,000 require competitive sealed bids as set forth in Section D.1.b.

The District wishes to repeal the existing Chapter IV of the Code and to replace by amendment of the proposed Chapter IV to update the Human Rights Ordinance and establish the Office of Prevention and Accountability to help the Park District meet its commitment to providing an equitable, inclusive, safe, and respectful recreation and work environment free from discrimination, harassment, sexual harassment, sexual misconduct, workplace violence, abuse and neglect of children and vulnerable adults, and retaliation.
